28 Maret 2019, melalui info daring, UAPM Inovasi mendapat dua pengaduan terkait kasus kekerasan seksual yang ada di UIN Maulana Malik Ibrahim Malang (UIN Maliki Malang). Setelah pembahasan bersama tim UAPM Inovasi, akhirnya kami berhasil mengetahui identitas dari salah satu penyintas pada 10 April 2019. Setelahnya, kami berusaha menemui dan meminta keterangan lebih lanjut kepada penyintas.
Kami pun menghubungi Adawiyah (bukan nama sesungguhnya) untuk menyimak detail penuturannya. Namun karena beberapa hal yang berkaitan dengan kesediaan dan kesibukan penyintas, akhirnya penyintas hanya mau bercerita melalui aplikasi berbalas pesan. Pada tanggal 19 April 2019 dia mulai bercerita perihal apa yang pernah ia alami selama kuliah di UIN Maliki Malang. Segala detail cerita yang kita sampaikan di bawah ini telah mendapatkan persetujuan dari penyintas.
Definisi kekerasan seksual yang kami gunakan mengacu pada 15 bentuk kekerasan seksual yang dirumuskan oleh Komisi Nasional (Komnas) Perempuan. Dalam rumusan tersebut dijelaskan bahwa pelecehan seksual merupakan suatu tindakan seksual baik melalui sentuhan fisik maupun non-fisik dengan sasaran organ seksual atau seksualitas korban. Termasuk menggunakan siulan, main mata, ucapan bernuansa seksual, mempertunjukkan materi pornografi dan keinginan seksual, colekan atau sentuhan di bagian tubuh, gerakan atau isyarat yang bersifat seksual sehingga mengakibatkan rasa tidak nyaman, tersinggung, merasa direndahkan martabatnya,dan mungkin sampai menyebabkan masalah kesehatan dan keselamatan.

Adawiyah merupakan mahasiswi Fakultas Humaniora, UIN Maliki Malang angkatan 2013. Kisah ini berawal ketika Adawiyah mulai duduk di semester 6, yaitu pada tahun 2016. Pada waktu itu Adawiyah mengikuti kelas yang diajar oleh Qarun (bukan nama sebenarnya) dan ia ditunjuk sebagai ketua kelas. Adawiyah menjelaskan bahwa Qarun punya kecenderungan memilih mahasiswa yang aktif untuk menjadi ketua kelas.
Setelah pemilihan ketua kelas, semua ketua kelas dari empat kelas yang diajar Qarun diminta mendatangi rumahnya. Adawiyah datang terlambat waktu itu. Dengan alasan tersebut Adawiyah diajak mengobrol dahulu yang membuatnya pulang paling terakhir. Keganjilan mulai dirasakan Adawiyah karena Qarun mulai berani pegang-pegang. “Beliau mulai genit gitu,” jelasnya.
Setelah hari itu, Adawiyah terus berusaha biasa saja dan melupakan apa yang pernah ia alami. Namun, Qarun tidak berhenti sampai di situ. Ketika mengajar di dalam kelas, Qarun juga bermain mata ke beberapa teman perempuan Adawiyah. “Di kelas-kelas yang lain juga ada incaran beliau dan ada kriterianya, ya cewek-cewek yang ceria, periang dan bisa diajak guyon, di kelasku itu ada dua, aku sama temenku,” tambah Adawiyah.
Tidak berhenti sampai disini, Qarun juga mulai berani menyentuh Adawiyah dan mengirim pesan singkat yang dirasa Adawiyah tidak terlalu penting. “Mulai berani skinship (bersentuhan kulit), terus ngirim pesan malam-malam,” terang Adawiyah. Ia juga beberapa kali ditawari ke rumah Qarun dengan alasan membantu mengerjakan tugas.
Gerak-gerik Qarun semakin kentara ketika Adawiyah ingin mengajukan judul skripsi. Pasalnya, Qarun kukuh untuk menjadi dosen pembimbing Adawiyah. “Aku gak pengen dibimbing beliau, aku pengen dibimbing orang lain,” terang Adawiyah. Tapi Qarun terus memaksa dan mengatakan jika ikut ke dalam kelompok bimbingannya, Adawiyah akan diarahkan dan diajari dengan baik. Namun Adawiyah tetap menolak hal itu. “Aku sendiri membatasi karena aku tahu sifat bapaknya seperti itu,” lanjut Adawiyah.
Hari-hari setelahnya, sikap Qarun ternyata tidak berubah. Pada suatu hari saat Adawiyah selesai kuliah, Qarun menghubungi Adawiyah dan memintanya untuk datang ke kantor. Ketika sampai di kantor, mereka mengobrol beberapa hal. Adawiyah juga menerangkan jika Qarun ingin mengajak Adawiyah untuk berangkat bersama keesokan harinya. Namun, Adawiyah menolak. “Besok jangan bawa motor, ayo bareng aku, besok aku lewat depan rumahmu,” ujar Adawiyah menirukan percakapannya dengan Qarun.
Benar saja, keesokan harinya Qarun melewati depan rumah Adawiyah. “Beliau telepon sampai tujuh kali,” tutur Adawiyah. Hingga akhirnya Adawiyah mengangkat telpon dari Qarun dan bercakap-cakap. Dalam percakapan tersebut Qarun berkukuh mengajak Adawiyah agar menerima tawarannya berangkat bersama. Namun, Adawiyah tetap menolak dengan alasan menjemput adiknya yang masih tinggal di Ma’had Sunan Ampel al Aly. Hingga akhirnya Qarun pergi dari depan rumahnya.
Hal lain yang membuat Adawiyah risih, ketika ia mengirim tugas via email kepada Qarun. Pasalnya tugas yang dikirim oleh Adawiyah dibalas dengan link video porno. Adawiyah pun menanyakan link tersebut untuk apa. “Ayo nonton bareng, kamu nonton di hpmu, nanti kita kasih komen sama-sama,” jelas Adawiyah menirukan isi pesan Qarun. Ada sekitar dua puluh tiga link video porno yang dikirimkan Qarun kepada Adawiyah dengan waktu berbeda-beda.
Tidak berhenti di situ, Adawiyah mengaku pernah hampir dicium oleh Qarun di area kampus dan diancam tidak diluluskan dari mata kuliah yang diajar Qarun. “Ya Allah, ya aku takutlah, pengen nangis juga. Mungkin aku bisa melaporkan hal itu sebagai pelecehan seksual ya, tapi ya gimana, waktu itu ndak ngerti,” tegas Adawiyah.
Hal inilah yang pada akhirnya mendorong Adawiyah untuk melaporkan kepada dosen lain. Tetapi ketika kami meminta keterangan terkait siapa dosen ini, Adawiyah enggan untuk menceritakannya. Adawiyah hanya menambahkan setelah Adawiyah melapor, dosen ini berjanji untuk segera memproses hal tersebut.
Sebelumya, Adawiyah juga sempat bercerita kepada kami bahwa ada beberapa korban lain dan terduga pelaku lain yang pada tahun 2016 juga melaporkan hal serupa kepada dekan. Pada awalnya Adawiyah setuju kasus ini diangkat karena ia tak ingin ada korban-korban lain. Dan yang masih meresahkan, beberapa terduga pelaku juga masih berkeliaran bebas di UIN Maliki Malang.
Lingkungan yang Tidak Mendukung Penyintas
Setelah Adawiyah melaporkan kasus ini kepada dosen yang ia percaya. Kasus ini menjadi perbincangan yang sangat riuh di fakultas. Ada beberapa mahasiswa yang pada akhirnya membuat sebuah sayembara untuk mengumpulkan fakta-fakta terkait kekerasan seksual.
“Temen-temenku yang lain itu sudah buat sayembara untuk menemukan bukti-bukti chattingan mesum dan bukti lainnya. Hadiahnya dulu itu hp samsung,” ujar Adawiyah. Ia menyayangkan hal ini karena fakultas bukan malah melindungi penyintas tetapi salah fokus hanya kepada pencarian bukti atas kasus ini.
Pada suatu ketika Adawiyah juga mendapat teror dari seorang perempuan yang ia duga sebagai istri dari Qarun. “Mungkin history callnya belum dihapus. Aku disms dan ditelepon selama tiga hari berturut-turut. Dalam sehari itu bisa 10-15 kali,” tutur Adawiyah. Adawiyah mengaku tidak merespon hal ini. Selain merasa takut, ia juga trauma. Asumsi yang beredar di fakultasnya, menyudutkan para penyintas. Selain itu, juga muncul tekanan dari terduga pelaku.
Sejak tanggal 7 Mei 2019 kami berusaha menghubungi Qarun untuk meminta konfirmasinya mengenai kasus ini namun ia tidak merespon. Baru pada tanggal 15 Mei 2019 ia menyatakan tidak bersedia diwawancarai karena merasa tidak pernah melakukan kekerasan seksual.
Adawiyah kembali bercerita bahwa setelah melapor kepada dekan fakultasnya, mereka berjanji akan memberikan teguran dan Surat Peringatan (SP) kepada Qarun. Selain itu dekan juga berjanji bahwa akan memindah tugaskan Qarun ketika mengulanginya lagi.
Setelah kami konfirmasi, Isti’adah yang pada tahun 2016 menjabat sebagai dekan Fakultas Humaniora mengaku tidak pernah mendapat laporan terkait pelecehan seksual yang terjadi di fakultasnya. “Kalau kasus mahasiswa yang saya tangani, enam mahasiwa pacaran, yang dua diluar jadi delapan, itu yang saya ingat. Kalau SP, kok saya ndak pernah merasa menulis surat. Ingat saya kok ndak ya,” tuturnya.
Senada dengan Isti’adah, Syafiyah, Dekan Fakultas Humaniora tahun 2019, juga mengatakan jika tidak pernah terjadi kasus kekerasan seksual di fakultasnya. Ia juga tidak bersedia diwawancarai lebih lanjut mengenai hal ini dengan alasan apa yang terjadi di fakultasnya tidak untuk dibicarakan diranah publik.
Namun, Maryam Jameelah, salah satu konselor dari Women Crisis Center (WCC) Dian Mutiara Malang, menjelaskan bahwa menerima tiga kasus pengaduan dari mahasiswi UIN Malang yang mengaku telah mengalami pelecehan seksual selain kasus Adawiyah pada Februari lalu. Dua dari mahasiwi tersebut berasal dari Fakultas Humaniora dan satu mahasiswi berasal dari Fakultas Psikologi.
Adawiyah menjadi susah dihubungi sejak kami mulai melakukan konfirmasi ke fakultasnya. Terakhir komunikasi terjadi pada tanggal 3 Mei 2019. Ia mengatakan kepada kami bahwa pihak fakultas telah mendengar ini dan melarang Adawiyah membukanya ke publik. Sampai detik ini, kami masih terus berupaya untuk kembali berkorespondensi dengan Adawiyah. Sampai artikel ini ditayangkan, Adawiyah belum mengkonfirmasi kembali.
UIN Dalam Menghadapi Kekerasan Seksual
UIN Maliki Malang belum siap untuk mengatasi kasus kekerasan seksual. Hal ini diakui oleh Isti’adah yang juga menjadi ketua Pusat Studi Gender dan Anak (PSGA). “Harus ditata dulu mekanismenya seperti apa. Untuk saat ini belum, kita masih merancang untuk membuat langkah-langkah preventif bukan hanya kuratif,” tuturnya.
Isti’adah menjelaskan jika masih banyak yang harus disiapkan UIN Maliki Malang. “Ketika saya membuka layanan, saya butuh psikolog, rohaniwan, juga ahli hukum,” ujarnya. Ia juga menambahkan akan melakukan pengkaderan yang masif, agar mahasiswa UIN Maliki Malang menganggap ini sebagai hal yang penting.
Dalam catatan Komnas Perempuan, yang dilansir oleh bbc.com, baru Sekolah Tinggi Teologi (STT) Jakarta yang memiliki pedoman anti kekerasan di lembaga pendidikan. Masruchah selaku Komisioner Komnas Perempuan menjelaskan jika penyelesaian kekerasan seksual di kampus yang sangat penting dan mendesak adalah dibangunnya mekanisme serta lembaga khusus di perguruan tinggi untuk menangani kasus pelecehan atau penyerangan seksual. “Seharusnya di perguruan-perguruan tinggi (lain) harus ada pula hal yang seperti (di STT Jakarta) ini, sebab fakta kasus kekerasan seksual di usia kuliah cukup banyak,” jelasnya.
Masruchah memberi contoh jika di STT Jakarta, sejak mahasiswa baru mulai belajar, sudah diperkenalkan dengan pedoman perilaku anti kekerasan seksual. “Pedoman itu menjadi pijakan yang ditandatangani oleh semua pihak, bahwa mereka tidak boleh melakukan kekerasan seksual dalam bentuk apapun. Kalau melakukan akan siap diberhentikan atau ada tindakan dari kampus. Sanksinya tegas,” jelas Masruchah.
Sependapat dengan Masruchah, Maryam Jameelah juga menegaskan jika kampus sebagai institusi pendidikan harus menyediakan lingkungan kondusif. “Bukan cuma sekedar kurikulum yang kondusif, tapi juga situasi yang kondusif, tenaga pengajar yang kondusif dan kampus harus tanggung jawab atas penyerangan yang terjadi pada mahasiswinya,” pungkasnya.
